These Terms of Service (“Terms”) govern your use of Dudel Draw, a mobile application published by Silly Little Apps LLC (“we,” “us,” or “our”). By using the app, you agree to these Terms.

Dudel Draw is a mobile application that provides users to draw on top of unique shapes to bring out their creativity and imagination daily.

You agree to use Dudel Draw only for lawful purposes and in a manner consistent with all applicable laws and regulations.

All drawings and streak data in Dudel Draw are stored locally on your device. You should be aware of the following:Drawings reset at midnight each day. Any drawing not saved or exported before midnight will be permanently deleted and cannot be recovered.Streak data is stored on your device. Uninstalling, reinstalling, or updating the app may result in the permanent loss of your streak count. We are not responsible for any loss of streak data under these circumstances.The home screen widget displays your current drawing based on locally stored data. Widget display is dependent on device conditions and is not guaranteed to be current at all times.Sharing your drawing is handled by Apple’s native share sheet. Any third-party apps you choose to share to are governed by their own terms and privacy policies. We are not responsible for how those apps handle your content.We are not liable for any loss of drawings or app data resulting from device failure, app deletion, or any other cause.

All content and materials within the app; including graphics, logos, icons, and software; are the property of Silly Little Apps LLC or its licensors and are protected by United States and international copyright law. You may not reproduce, modify, distribute, or otherwise use any app content without our prior written consent.

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY FOR INFORMATION, SERVICES, UNINTERRUPTED ACCESS, OR PRODUCTS PROVIDED THROUGH OR IN CONNECTION WITH THE APP, INCLUDING WITHOUT LIMITATION THE SOFTWARE LICENSED TO YOU AND THE RESULTS OBTAINED THROUGH THE APP. SPECIFICALLY, WE DISCLAIM ANY AND ALL WARRANTIES, INCLUDING WITHOUT LIMITATION: 1) ANY WARRANTIES CONCERNING THE AVAILABILITY, ACCURACY, USEFULNESS, OR CONTENT OF INFORMATION, PRODUCTS OR SERVICES; AND 2) ANY WARRANTIES OF TITLE, WARRANTY OF NON-INFRINGEMENT, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

IN NO EVENT SHALL WE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF THE APP OR WITH THE DELAY OR INABILITY TO USE THE APP, OR FOR ANY INFORMATION, PRODUCTS, AND SERVICES OBTAINED THROUGH THE APP, OR OTHERWISE ARISING OUT OF THE USE OF THE APP, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF DAMAGES.

You agree to indemnify and hold Silly Little Apps LLC harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of the app, your violation of these Terms, or your violation of any rights of another.

These Terms are governed by the laws of the State of Utah, without regard to its conflict of laws principles. Any legal action arising out of or relating to these Terms shall be brought exclusively in the courts of the State of Utah.

We reserve the right to modify these Terms at any time. Your continued use of the app following any modification constitutes your agreement to be bound by the updated Terms.
